China Law Society Delegation Successfully Held The Training Program Of The Structure Of Different Judicial Powers In France

Approved by the State Administration of Foreign Experts Affairs, China Law Society sent a 22-member delegation to visit France from October 19 to November 8, 2014 to hold a legal training program focused on the structure of different judicial powers at the invitation of Aix-Marseille University. The delegation was led by Mr. Yin Baohu, Director General of China Legal Exchange Center, and scholars of judicial studies and some practitioners from the Public Security Bureaus, People’s Procuratorates, People’s Courts and Justice Bureaus of 15 provinces attended this training program.

Mr. Pierre CROCQ giving lecture on Judicial Independence, Judges and Prosecutors
 
The delegation had 15 lectures separately at the Law School of University of Paris II, French National School for the Judiciary and Aix-Marseille University successively. The topics covered the principle of the structure of different judicial powers of France, the relations between judge, procurator, policeman and lawyer, the characteristics of French Procedural Laws, the recruiting, training and occupational security of the judiciary, judicial codes of ethics and disciplinary measures, the constitutional review system, the Administrative Court and the ordinary courts and so on; paid 5 times to courts in session at the Tribunal de Grande Instance of Versailles and the Appeal Court of Aix-en-Provence; visited the Ministry of Justice of France, Société de législation compare, the Police Station of District 14 of Paris, Louit Law Firm and Bar Association of Aix-en-Provence and had discussions with the above-mentioned organizations; held 2 internal workshops to exchange achievements of this training program.

This training program was highly valued by the relevant French organizations and the delegation received warm reception. Ministry of Justice of France helped arrange the visits to the judicial organs; the Law School of University of Paris II, French National School for the Judiciary and Aix-Marseille University invited well-known legal experts and senior judges, prosecutors and lawyers with both profound academic and practical experiences to give lectures to the delegation. Each lecture and practical visit included two-hour presentation and one-hour interactive discussion, and sometimes several academic and practical experts came together to explain the key topics. The quality and level of this training program were thought highly by all the delegates.

During the training, all the delegates attentively listened to the lectures, actively asked questions and took part in discussions which left the French colleagues a deep impression. In the communication process, the delegation also took the initiative to introduce the latest achievements made by China in the construction of the rule of law, especially the goals and initiatives on a new round of judicial reform mentioned in "The decision of the CPC Central Committee on the comprehensive promotion of several major issues of the rule of law" approved by the fourth plenary session of 18th Central Committee of the Communist Party of China which made French colleagues have a clearer understanding of the road, the system and the theory of the rule of law with Chinese characteristics. Under the joint efforts of all members, the delegation successfully fulfilled all the objects of the training program, enhanced understanding, friendship and trust with French counterparts, expanded consensus and cooperation, and reached a complete success.
